Statutory text

Bare law

(1) The Central Authority may, after receiving any information or complaint or directions from the Central Government or of its own motion, conduct or cause to be conducted a preliminary inquiry as to whether there exists a prima facie case of violation of consumer rights or any unfair trade practice or any false or misleading advertisement, by any person, which is prejudicial to the public interest or to the interests of consumers and if it is satisfied that there exists a prima facie case, it shall cause investigation to be made by the Director-General or by the District Collector. (2) Where, after preliminary inquiry, the Central Authority is of the opinion that the matter is to be dealt with by a Regulator established under any other law for the time being in force, it may refer such matter to the concerned Regulator along with its report. (3) For the purposes of investigation under sub-section (1), the Central Authority, the Director General or the District Collector may call upon a person referred to in sub-section (1) and also direct him to produce any document or record in his possession.

Introduction

The Authority may receive information, a complaint or government direction, or act on its own motion. If its preliminary inquiry finds a prima facie case prejudicial to public or consumer interests, it causes an investigation by the Director-General or District Collector.

It may refer a matter better handled by another regulator and can call for relevant documents or records. The preliminary inquiry, investigation and any eventual direction are separate steps.

Key takeaways

1

Several triggers

Information, complaints, Central Government directions and the Authority's own motion can start preliminary inquiry.

2

Prima facie threshold

Investigation follows if the Authority is satisfied that a prima facie case exists under subsection (1).

3

Referral or records

The Authority may refer a matter to another regulator and can require a person to produce documents or records in their possession.

Classify the issue in the notice

Identify whether the concern is consumer rights, an unfair trade practice or a false or misleading ad, and what conduct is said to prejudice the public or consumers.

Separate inquiry from final order

A preliminary inquiry or investigation is not itself a section 20 recall or section 21 ad direction. Track each notice, legal basis and deadline separately.

Prepare a complete records response

Locate requested ads, claims, transaction records, complaints and product or service documents. Preserve originals and document what was produced and when.

Hypothetical example

A cluster of buyers reports that a seller concealed a safety defect. The CCPA assesses whether to direct investigation or refer the matter to the appropriate regulator; the seller preserves product, complaint and corrective-action records for the selected process.

Practical checklist

Do

  • Keep a clear record of CCPA correspondence and deadlines.
  • Preserve relevant records before an investigation response.
  • Check whether another sector regulator is involved.

Avoid

  • Do not assume a prima facie inquiry is a final finding.
  • Do not destroy or alter records after a production request.
