Statutory text

Bare law

This Chapter shall apply to every claim for compensation under a product liability action by a complainant for any harm caused by a defective product manufactured by a product manufacturer or serviced by a product service provider or sold by a product seller.

Introduction

The chapter concerns a complainant's claim for compensation for harm caused by a defective product. Its wording covers products manufactured by a product manufacturer, serviced by a product service provider or sold by a product seller.

This scope provision does not itself establish that a particular business is liable. Section 83 identifies who may be sued, while sections 84–87 set conditions and exceptions.

Key takeaways

1

Compensation and harm

Chapter VI applies to compensation claims in a product-liability action for harm from a defective product.

2

Three possible roles

The statutory scope includes a manufacturer, a product service provider and a seller; the relevant role depends on the product and transaction.

3

Read the following sections

Sections 83–87 provide the action, role-specific liability tests and exceptions. Section 82 alone is not a finding of liability.

Check the claim type

First identify the complainant, alleged harm and defective product. Chapter VI concerns compensation under a product-liability action, not every customer complaint.

Map each business role

Record who manufactured, serviced and sold the product. More than one role may need assessment, but each role's statutory liability test is separate.

Apply the role-specific tests

Use section 84 for manufacturers, section 85 for product service providers and section 86 for sellers. Then test section 87's exceptions against the evidence.

Hypothetical example

A buyer alleges injury from a defective household appliance. The business first checks whether the claim concerns harm caused by a defective product within Chapter VI, then examines the applicable manufacturer, service-provider or seller provision.

Practical checklist

Do

  • Preserve the product, purchase and service records after a reported injury.
  • Identify each party's actual role before assessing a claim.
  • Read the Act's definitions of defect and harm alongside Chapter VI.

Avoid

  • Do not infer liability from section 82 alone.
  • Do not treat every refund or service complaint as a product-liability compensation action.

Frequently asked questions

Does the chapter apply only to manufacturers?

No. Section 82 also refers to product service providers and sellers.

Does section 82 itself award compensation?

No. It defines the chapter's application; the remaining provisions and facts govern the action and liability.
