Statutory text

Bare law

When any partner in a registered firm alters his name or permanent address, an intimation of the alteration may be sent by any partner or agent of the firm to the Registrar, who shall deal with it in the manner provided in section 61.

Central rule and applicability

Any partner or agent of the registered firm may send an intimation of the partner's name or permanent-address alteration. The Registrar deals with it through the recording and filing method in Section 61.

Limits and related provisions

A partner joining or leaving changes the firm's constitution and should be examined under Section 63; changing the firm's name is governed by Section 60. Section 62 does not itself resolve an identity or entitlement dispute. State forms and supporting-evidence requirements must also be checked.

Hypothetical business example

Hypothetical: a partner legally changes her name while the firm's name and membership remain unchanged. The firm submits the personal-particulars intimation with the evidence required by its State procedure and verifies that the same partner's record has been updated.

Practical decision flow

Identify whether the change is a partner's personal name/permanent address or a different type of firm change.

Prepare the accurate intimation and supporting identity or address evidence required by the State procedure.

Check the updated register note and align the changed particulars in relevant business records.

Check the applicable state law

This guide explains the central Section 62 baseline. State amendments, notifications and rules can affect its application. Confirm the law applicable to the firm's location and the relevant partnership agreement before acting.

Practical checklist

Do

  • Prepare the accurate intimation and supporting identity or address evidence required by the State procedure.
  • Check the updated register note and align the changed particulars in relevant business records.

Avoid

  • A partner joining or leaving changes the firm's constitution and should be examined under Section 63; changing the firm's name is governed by Section 60. Section 62 does not itself resolve an identity or entitlement dispute. State forms and supporting-evidence requirements must also be checked.

Glossary

Permanent address
The partner's permanent address referred to by this provision, distinct from a branch address.
Constitution of a firm
Its partnership composition, a different issue from correcting a continuing partner's personal particulars.

Frequently asked questions

Must the affected partner alone send the intimation?

The central provision allows any partner or agent of the firm to send it. Applicable authorisation and filing rules still matter.

Is a new partner's admission merely a Section 62 update?

No. Admission changes the firm's constitution and requires consideration of Section 63 and the substantive partnership rules.

Does this change the firm's name?

No. The firm's own name alteration is a Section 60 matter.
