Statutory text
Bare law
(1) This Act may be called the Indian Partnership Act, 1932.
(2) It extends to the whole of India.
(3) It shall come into force on the 1st day of October, 1932, except section 69, which shall come into force on the 1st day of October, 1933.
Central rule and applicability
The central Act extends to the whole of India. It commenced on 1 October 1932, with Section 69 commencing on 1 October 1933. These are the Act's historical commencement dates, rather than registration deadlines for a newly formed firm.
Limits and related provisions
The former Jammu and Kashmir exclusion was omitted by the 2019 reorganisation legislation, effective 31 October 2019. Older copies retaining that exclusion need the amendment applied. Nationwide extent does not mean that every state's registration rules or local amendments are identical.
Hypothetical business example
Hypothetical: A founder sees a scanned version excluding Jammu and Kashmir. The adviser checks the central amendment and uses the current all-India extent, then separately checks the rules applicable where the firm operates.
Practical decision flow
Confirm the instrument is the Indian Partnership Act, 1932, rather than the separate LLP legislation.
Use the amended territorial extent and distinguish the Act's commencement from a firm's own start date.
Identify the state or territory whose amendments, registration rules and procedures affect the proposed firm.
Check the applicable state law
This guide explains the central Section 1 baseline. State amendments, notifications and rules can affect its application. Confirm the law applicable to the firm's location and the relevant partnership agreement before acting.
