Statutory text
Bare law
Where a person pledges goods in which he has only a limited interest, the pledge is valid to the extent of that interest.
Rule and business relevance
The security must be measured against what the pawnor actually holds. Possession does not enlarge a limited interest into full ownership.
Limits and related provisions
Value the legal interest being pledged and consider any other relevant authority or title provision. Do not promise unrestricted security over the whole asset.
Hypothetical business example
Hypothetical example: A person entitled only to a limited interest in goods pledges them. The financier’s valid security under this rule extends no further than that interest.
