Statutory text
Bare law
If several joint owners of goods bail them, the bailee may deliver them back to, or according to the directions of, one joint owner without the consent of all in the absence of any agreement to the contrary.
Rule and business relevance
The default does not require consent of every joint owner, but it applies only in the absence of an agreement to the contrary.
Limits and related provisions
Check the actual joint bailment and any requirement for joint instructions. A known third-party claim or court order needs separate attention.
Hypothetical business example
Hypothetical example: Two co-owners jointly deposit equipment. Unless their agreement requires both signatures, section 165 permits return to one joint owner.
Practical decision flow
Confirm that the bailors are joint owners.
Read any contrary instruction or agreement.
Record the recipient and delivery directions.
Check the applicable legal framework
This guide explains the central provision. Applicable State amendments, the agreement, transaction date and other governing laws can affect its application. Check the current legal framework before relying on it for a commercial decision.
