Introduction
Rule 24 is a wholesale-package declaration rule. It lists a shorter set of particulars than retail-package Rule 6; the two kinds of packages should be classified before artwork is finalised.
Key takeaways
Identify the responsible business
The declaration names and addresses the manufacturer or importer; where that party is not the packer, the packer is identified as the rule specifies.
Describe contents and amount
The package must identify the commodity and give either the total number of retail packages or the net quantity in standard units of weight, measure or number.
The other-law proviso is narrow
Rule 24 does not apply to a wholesale package when a similar declaration is required on it by or under another law. Verify the actual other-law requirement before relying on this proviso.
Classify the outer package
Confirm that the item being reviewed is a wholesale package under the Rules. A carton used for wholesale distribution may need its own declaration even when the inner retail packs carry labels.
Check the three declaration groups
Inspect the outer-package artwork for the business name and address, commodity identity and count or net quantity. The rule requires the text to be legible, definite, plain and conspicuous.
Document any other-law exception
If an equivalent wholesale-package declaration is required by another applicable law, retain that provision and the actual declaration as the basis for invoking Rule 24's proviso.
Practical checklist
Do
- Review the wholesale carton separately from retail packs.
- Count inner retail packages or state the net quantity in standard units.
- Keep the alternative-law basis if invoking the proviso.
Avoid
- Do not assume retail-pack artwork automatically satisfies the outer-carton duty.
- Do not use the other-law proviso without a similar required declaration.
