Statutory text

Bare law

Subject to the provisions hereinafter contained as to crossed cheques, a negotiable instrument indorsed in blank is payable to the bearer thereof even although originally payable to order.

Key rule and applicability

A negotiable instrument indorsed in blank is payable to its bearer under the stated rule. The provision expressly subjects that result to the later rules about crossed cheques.

Limits and related provisions

Bearer-payment effect is not the same as eliminating a crossed-cheque restriction or curing an unlawful title. Read the relevant crossing, negotiation and title provisions alongside the blank indorsement.

Hypothetical business example

Hypothetical: an order bill is indorsed in blank and transferred. The recipient identifies its bearer-payment effect while separately checking the title chain and any applicable restrictions.

Practical decision flow

Confirm that the indorsement is genuinely in blank.

Identify the resulting payment form.

For a cheque, check the crossing provisions and retain the original instrument or image.

Frequently asked questions

Can an originally order instrument become payable to bearer under this rule?

Yes, through a blank indorsement as stated.

Are crossed-cheque provisions overridden?

No. The section is expressly subject to them.

Does blank indorsement automatically cure a title defect?

This payment-form rule does not itself erase the separate title requirements.
