Statutory text
Bare law
Any amendment of regulations referred to in sub-section (1) of section 63 shall not be effective unless the amended regulations are filed with the Registrar, and accepted and published by him in accordance with section 64.
Rule and business relevance
Internal association approval alone does not complete the section’s requirements. Acceptance and publication follow section 64.
Limits and related provisions
Do not enforce a newly voted mark-use amendment as if the Registry conditions had already changed without checking these steps.
Hypothetical business example
Hypothetical example: Members approve a revised eligibility condition. The association files the amendment and waits for the required acceptance and publication before treating it as effective under this provision.
Practical decision flow
Document the proposed regulation amendment.
File it with the Registrar.
Verify acceptance and publication before relying on its effect.
Applying the Act and current procedure
Read the statutory rule together with the applicable Trade Marks Rules, current Registry directions and the facts of the particular mark. Forms, fees and procedural requirements should be checked against their current official source before filing.
