Statutory text

Bare law

(1) This Act may be called the Trade Marks Act, 1999.

(2) It extends to the whole of India.

(3) It shall come into force on such date as the Central Government may, by notification in the Official Gazette, appoint:

Provided that different dates may be appointed for different provisions of this Act, and any reference in any such provision to the commencement of this Act shall be construed as a reference to the coming into force of that provision.

Rule and business relevance

The Act extends to the whole of India. Its provisions come into force on dates appointed by the Central Government through Gazette notification, and different dates may apply to different provisions.

Limits and related provisions

Do not confuse the Act’s title year or assent with every provision’s commencement. Later amending Acts can have their own effective-date requirements, so the version applicable to a dispute must be checked.

Hypothetical business example

Hypothetical example: a business reviewing an older mark dispute identifies the transaction date and relevant commencement or amendment notification before applying a current procedural provision.

Practical decision flow

Identify the relevant provision and date of the matter.

Check its commencement and any amending provision’s effective date.

Use the applicable statutory version and current procedural source.

Applying the Act and current procedure

Read the statutory rule together with the applicable Trade Marks Rules, current Registry directions and the facts of the particular mark. Forms, fees and procedural requirements should be checked against their current official source before filing.

Practical checklist

Do

  • Identify the relevant provision and date of the matter.
  • Check its commencement and any amending provision’s effective date.
  • Use the applicable statutory version and current procedural source.

Avoid

  • Do not confuse the Act’s title year or assent with every provision’s commencement. Later amending Acts can have their own effective-date requirements, so the version applicable to a dispute must be checked.

Glossary

Extent
The territorial application of the Act, here the whole of India.
Commencement
The bringing into force of a provision through the specified notification framework.
