Rule 4

Rule 4: duties of e-commerce entities

Rule 4 sets platform-level duties for e-commerce entities. Its sub-rule (1) was replaced by the final 2021 amendment, so the original 2020 wording should not be used as the current requirement.

Notified future change: A further notified 2026 amendment changes parts of rule 4 from 1 January 2027, including complaint records, sponsored listings, price reductions and other platform duties. Those future duties are not presented here as current law.

Introduction

Start by checking whether the business is an e-commerce entity under rule 3(1)(b). The rule distinguishes the operator of a digital commerce facility from a seller using a marketplace; sellers have separate duties under rule 6.

For the categories of entity specified in amended rule 4(1), appoint a nodal officer or alternate senior designated functionary resident in India to ensure compliance with the Consumer Protection Act and rules. The 2021 final amendment replaced only sub-rule (1); the rest of rule 4 remains in the principal Rules.

Key takeaways

Use the amended text

The final May 2021 Gazette substituted rule 4(1). The separate 2021 consultation draft did not itself change the law.

Display operator information

Rule 4(2) requires prominent, accessible platform information about the entity, address, website and customer-care and grievance contacts.

Grievance periods are express

The platform's grievance officer must acknowledge a complaint within 48 hours and redress it within one month from receipt under current rule 4(5).

Consent must be active

Rule 4(9) requires explicit affirmative action for purchase consent; pre-ticked checkboxes cannot record it automatically.

Identify the operator and the applicable entity category

Check who owns, operates or manages the platform. Then assess whether amended rule 4(1)'s company, foreign company or specified overseas-office category applies before documenting the India-resident nodal appointment.

Audit visible business and support details

Check the site and app for the legal name, head-office and branch addresses, website details, and customer-care and grievance-officer contacts required by rule 4(2). The details should be easy for a user to find before and after purchase.

Operate a grievance process

Maintain a complaint channel, assign a grievance officer and retain complaint receipts and resolution records. Rule 4(4) addresses the mechanism and officer disclosures; current rule 4(5) requires acknowledgement within 48 hours and redressal within one month of receiving the complaint.

Check cancellation, consent and refunds

Rule 4(8) restricts cancellation charges imposed on a consumer who cancels after purchase confirmation unless similar charges are borne by the e-commerce entity when it unilaterally cancels. Rule 4(9) calls for explicit affirmative purchase consent, not pre-ticked boxes. Rule 4(10) addresses payments against accepted refund requests in accordance with applicable payment-law periods.

Keep marketplace and seller duties separate

Rule 4 applies to the e-commerce entity. A marketplace seller has additional duties under rule 6. A business operating both functions should map the obligations for each role.

Practical checklist

Do

  • Record the legal basis for classifying the entity under amended rule 4(1).
  • Name and document the resident nodal officer where that sub-rule applies.
  • Test customer-care and grievance contacts on mobile and desktop.
  • Retain complaint and refund records.

Avoid

  • Do not apply the superseded original rule 4(1) as current text.
  • Do not treat the unnotified 2021 consultation draft as a final rule.

FAQs

Did the 2021 amendment replace all of rule 4?

No. The notified amendment substituted sub-rule 4(1); the other sub-rules of rule 4 in the principal 2020 Rules continue to require separate reading.

Is every marketplace seller required to appoint the rule 4(1) nodal officer?

Rule 4(1) addresses the specified categories of e-commerce entity. A seller using a marketplace should separately assess rule 6 and whether it also operates an e-commerce entity.
