Statutory text

Bare law

A person who is interested in the payment of money which another is bound by law to pay, and who therefore pays it, is entitled to be reimbursed by the other.

Illustration

B holds land in Bengal, on a lease granted by A, the zamindar. The revenue payable by A to the Government being in arrear, his land is advertised for sale by the Government. Under the revenue law, the consequence of such sale will be the annulment of B’s lease. B, to prevent the sale and the consequent annulment of his own lease, pays to the Government the sum due from A. A is bound to make good to B the amount so paid.

Rule and business relevance

The payment must discharge money the other person is bound by law to pay, and the payer must be interested in its payment and pay for that reason. The statutory illustration concerns a tenant protecting a lease from a revenue-sale consequence.

Limits and related provisions

A volunteer paying someone else's bill without the required interest should not assume Section 69 applies. Identify the legal obligation and the payer's interest rather than relying only on a bank transfer. Any separate agreement or reimbursement route may need independent assessment.

Hypothetical business example

Hypothetical: a person pays another's legally payable dues to prevent a direct adverse consequence for the payer's own existing interest. The claim records that interest and necessity of payment rather than presenting it as an unsolicited favour.

Practical decision flow

Identify the money the other person was bound by law to pay.

Establish the payer's interest in that payment and why the payment was made.

Preserve proof of discharge and quantify the reimbursement sought from the legally liable person.

Check the applicable legal framework

This guide explains the central provision. Applicable State amendments, the agreement, transaction date and other governing laws can affect its application. Check the current legal framework before relying on it for a commercial decision.
