Chapter II - Of Contracts, Voidable Contracts and Void Agreements

Section 30

Section 30: Wagering agreements

Section 30 makes wagering agreements void and bars the described recovery suits. It contains a narrow exception for qualifying horse-race prize contributions, which should not be confused with a general authorisation of betting.

Statutory text

Bare law

Agreements by way of wager are void; and no suit shall be brought for recovering anything alleged to be won on any wager, or entrusted to any person to abide the result of any game or other uncertain event on which any wager is made.

Exception in favour of certain prizes for horse-racing.—This section shall not be deemed to render unlawful a subscription or contribution, or agreement to subscribe or contribute, made or entered into for or toward any plate, prize or sum of money, of the value or amount of five hundred rupees or upwards, to be awarded to the winner or winners of any horse-race. Section 294A of the Indian Penal Code not affected.—Nothing in this section shall be deemed to legalize any transaction connected with horse-racing, to which the provisions of section 294A of the Indian Penal Code (45 of 1860) apply.

Rule and business relevance

The bar includes sums alleged to be won on a wager and sums entrusted to abide the result of a game or other uncertain event on which a wager is made. The horse-race wording concerns a subscription or contribution toward a qualifying prize of at least the stated five hundred rupees, with the additional statutory saving shown in the text.

Limits and related provisions

The historic prize figure is not a universal permitted betting stake. Applicable State gaming laws, current criminal law and rules for particular activities require separate review. The central voidness rule should not be paraphrased as either legalising all wagering or establishing that every contingent commercial contract is a wager.

Hypothetical business example

Hypothetical: a business is asked to enforce payment of a private bet after an event. It distinguishes that wager from an ordinary commercial contingency and examines Section 30 and applicable gaming laws rather than relying on the amount involved.

Practical decision flow

Identify whether the transaction is a wager or a different legally recognised commercial arrangement.

Assess the exact recovery sought and whether any narrow statutory exception is actually relevant.

Check the applicable State and current regulatory/criminal framework before offering, participating in or enforcing the arrangement.

Check the applicable legal framework

This guide explains the central provision. Applicable State amendments, the agreement, transaction date and other governing laws can affect its application. Check the current legal framework before relying on it for a commercial decision.

Frequently asked questions

Does the five-hundred-rupee figure legalise every bet above that amount?

No. It belongs to the narrow horse-race prize contribution wording.

Is every contract depending on an uncertain event a wager?

No. Contingent contracts and other arrangements need proper classification under the relevant provisions.

Does central voidness settle every State gaming-law issue?

No. Applicable State legislation and other legal consequences must be checked separately.
