What is trademark registration in India?
Trademark registration in India is the process of legally registering a brand identifier - a word, logo, slogan, sound, or combination - with the Office of the Controller General of Patents, Designs and Trademarks (CGPDTM). Once registered, you get exclusive rights to use that mark across the entire country for the goods or services specified in the application.
The Trade Marks Act, 1999 governs trademark law in India. A registered trademark provides prima facie evidence of ownership, making it significantly easier to take legal action against anyone who uses a similar or identical mark. Without registration, enforcing your brand rights requires proving prior use and acquired distinctiveness - which is time-consuming, expensive, and uncertain.
Trademark registration is valid for 10 years from the date of application and can be renewed indefinitely for further 10-year periods. You can use the TM symbol immediately after filing, and the R symbol after the registration certificate is issued. The mark is published in the Trademark Journal for a 4-month opposition period before final registration.
TM vs ®: understand the difference
Many people confuse the two symbols. Here is what each actually means legally.

प्रक्रिया
How trademark registration actually works
The TM registration process has 7 steps. Objections and oppositions are the two main delays. Here is what really happens at each stage.
Trademark search
We search the IP India database (plus common law sources) to check if your mark is available in your class. A negative search result saves you the filing fee. We do this before you commit.
TM-A application filing
We prepare and file Form TM-A on the IP India portal with all required details, class selection, and supporting documents. Government fee: ₹4,500 (individual) or ₹9,000 (company).
Examination report
The Trademark Registry issues an examination report within 30-45 days. It may raise objections under Section 9 (absolute grounds) or Section 11 (relative grounds). We respond within 30 days of the report.
Objection response (if raised)
If the Registry objects, we prepare a detailed response with evidence of distinctiveness, prior use, and legal arguments. We also request a hearing if needed. This step can add 2-4 months.
Journal publication
Once cleared, the mark is published in the Trademark Journal. This opens a 4-month opposition window during which anyone can oppose the registration.
Opposition handling (if any)
If opposed, we draft a counter-statement, file evidence, and represent you at the hearing. Most oppositions are resolved at the evidence stage without a formal hearing.
Registration certificate
If no opposition or after opposition is resolved, the Registry issues the Trademark Registration Certificate. Valid for 10 years from the filing date. Renewable indefinitely.
The 18-24 month timeline assumes no objections or oppositions. In reality, about 40-50% of applications receive at least one objection. Our job is to navigate those objections so your mark still registers. The government fee is non-refundable, which is why the search step matters so much - a bad mark that gets filed anyway wastes both time and money.
समय-सीमा
How long does trademark registration take?
The timeline varies significantly depending on whether objections or oppositions arise.
| चरण | समय |
|---|---|
| Trademark search | 1-2 days |
| TM-A application filing | Same day |
| Examination report | 30-45 days |
| Objection response (if any) | 2-4 months |
| Journal publication | Immediately after clearance |
| Opposition period (4 months) | 4 months (may extend) |
| Registration certificate | 2-4 weeks after clearance |
Best case (no objections, no opposition): 6-8 months. Typical case (one objection round, no opposition): 12-18 months. Complex case (objection + opposition): 24-36 months. We advise on realistic timelines during the initial consultation.

फ़ायदे
Why trademark registration matters
Legal protection
- Exclusive nationwide rights - no one else can use your mark for similar goods/services in India(Trade Marks Act, 1999, Section 28)
- Prima facie evidence of ownership - stronger position in court without proving use(Trade Marks Act, 1999, Section 29)
- Right to sue for infringement and claim damages or injunction
Business value
- Intangible asset - trademarks are property that appreciates in value and can be licensed or sold(Trade Marks Act, 1999, Section 31)
- Investor requirement - VCs and angel investors almost always check IP status during due diligence
- Franchise and licensing - a registered trademark is mandatory for franchising under Indian law
Brand security
- Deterrence - the R symbol warns competitors your brand is legally protected
- Platform protection - Amazon Brand Registry, Flipkart Seller protection, and social media verification require a registered trademark
- Customs enforcement - record your trademark with Indian customs to block counterfeit imports
International filing
- Madrid System - a registered Indian trademark is the foundation for international registration in 130+ countries through WIPO
- Priority claim - you can claim priority from an Indian filing for international applications within 6 months
अक्सर होने वाली गलतियाँ
Common trademark registration mistakes
Skipping the trademark search before filing
A thorough search prevents wasting ₹4,500-₹9,000 on an application that will be objected to. We search the IP India database, common law sources, and similar marks before you file.
Choosing the wrong Nice Classification class
There are 45 classes and most businesses fall into more than one. Filing in the wrong class means your protection does not cover your actual products or services. We advise on the correct class selection before filing.
Using a descriptive or generic name as the trademark
Words that directly describe your product (e.g. 'Spicy Kitchen' for a restaurant) are barred under Section 9. An invented or arbitrary name has a much higher chance of registration.
Not responding to examination reports on time
You have 30 days from the examination report date to respond. Missing this deadline is treated as abandonment - the application is dead and you must file a new one.
Ignoring the opposition period
After journal publication, there is a 4-month opposition window. Monitor the journal and respond promptly if someone opposes. We handle this automatically for Standard and Premium clients.

A trademark is any sign capable of being represented graphically that distinguishes the goods or services of one business from others. This includes words (Word Marks like 'Nike'), logos and designs (Device Marks like the swoosh), slogans, sounds, 3D shapes, and even colors or color combinations. Slogans like Nike's 'Just Do It' and jingles like the Nokia tune are registered trademarks.
The typical timeline is 18-24 months from filing to registration certificate. This breaks down as: trademark search (1-2 days), TM-A filing (same day), examination report (30-45 days), objection response if needed (2-4 months), journal publication, 4-month opposition period, and certificate issuance (2-4 weeks). If no objections or oppositions arise, the process can complete in 6-8 months.
A registered trademark is valid for 10 years from the date of filing. It can be renewed indefinitely for successive 10-year periods by paying the renewal fee (currently ₹9,000 for one class). Renewal applications should be filed 6 months before expiry. After expiry, there is a 6-month grace period with a late fee (surcharge), after which the mark is removed from the register.
The TM symbol can be used immediately after filing the trademark application and simply means you are claiming rights to the mark. It provides no legal protection - you cannot sue for infringement. The R symbol can only be used after receiving the Registration Certificate from IP India. It signifies a registered trademark and gives you full legal rights to sue for infringement under the Trade Marks Act, 1999. Using the R symbol before registration is illegal.
The Nice Classification system has 45 classes - 34 for goods (e.g. Class 25 for clothing, Class 9 for electronics/software) and 11 for services (e.g. Class 35 for advertising/retail, Class 42 for software development/design). Most businesses need more than one class. Choosing the wrong class means your protection does not cover your actual products. Our trademark experts advise on the correct class selection during the search phase.
If a similar trademark is already registered for the same or similar goods/services, your application may be refused under Section 11 (relative grounds of refusal). You can: (1) argue that your mark is visually, phonetically, and conceptually different, (2) provide evidence of prior use and acquired distinctiveness, (3) file a counter-statement if an opposition is filed, or (4) modify your mark. Our team guides you through the best strategy.
Company registration (with MCA) and trademark registration (with CGPDTM) are separate processes. Registering a company name with MCA does not give you trademark protection. Another business can use a similar name as a brand for their products/services. Trademark registration provides brand-specific protection and is essential for safeguarding your brand identity.
Trademark infringement occurs when someone uses a mark identical or deceptively similar to your registered trademark for the same or similar goods/services without your consent. You can: (1) send a cease-and-desist notice, (2) file a civil suit for injunction and damages, (3) file a criminal complaint for passing off, (4) use customs recordal to block counterfeit imports. A registered trademark significantly strengthens all these actions.
If someone files a trademark application with your brand name before you do, you can oppose it within 4 months of its publication in the Trademark Journal. If the mark is already registered, you can file a cancellation petition at the IPAB or file a passing-off suit in court. Prompt action is critical - delays weaken your case. Our legal team can handle oppositions and cancellation proceedings.
No, trademark registration is not mandatory in India. You can use a trademark without registering it, relying on common law passing-off action for protection. However, registered trademark protection is significantly stronger: you get exclusive rights, a legal presumption of ownership, the ability to sue for infringement (not just passing off), and nationwide protection. Registration is strongly recommended for any business with a brand.
Yes. You can file separate applications for a Word Mark (name only), Device Mark (logo only), or a combined Word + Device Mark. Filing separately gives broader protection - if someone uses just your name without your logo, the separate word mark covers it. We recommend filing the word mark first as it provides the strongest protection.
The Madrid System is administered by WIPO and allows you to file a single international trademark application to protect your mark in 130+ member countries, based on your existing national registration. India joined the Madrid System in 2013. You must have a basic Indian trademark registration (or application) before filing internationally. This is the most cost-effective way to protect your brand globally.
If the Registry rejects your application (under Section 9 or 11), you have 30 days to file a response (a 'reply to examination report'). If the Registry maintains the refusal, you can request a hearing before the Trademark Registry. If refused even after the hearing, you can appeal to the Intellectual Property Appellate Board (IPAB). Rejections can be overcome with proper legal arguments and evidence.
Core documents: (1) Applicant's name, address, and nationality, (2) List of goods/services with Nice Classification class numbers, (3) Trademark/logo image, (4) Power of Attorney if filing through an agent. For companies: (1) Certificate of Incorporation, (2) PAN of the company, (3) Board resolution. For individuals: PAN and address proof. Additional documents depend on the applicant type and whether prior use is claimed.
Yes. You can use the TM symbol (™) after filing the application, even before registration. This signals that you are claiming trademark rights. However, this does not provide the legal protection of the R symbol (®). Under the Trade Marks Act, 1999, a trademark does not need to be registered to be protected - unregistered marks are protected under the 'passing off' action, but this is harder to enforce than registered trademark infringement.
