What is ITR filing for proprietorships?
A sole proprietorship is not a separate legal entity - the proprietor and the business are the same for tax purposes. The business income is clubbed with the proprietor's personal income and taxed according to individual income tax slab rates. ITR-3 or ITR-4 is used depending on the nature and complexity of income.
ITR-4 (Sugam) is available under presumptive taxation schemes: Section 44AD for business income (8% of gross/total receipts if digital, 6% if other), and Section 44ADA for professional income (50% of gross receipts). This eliminates the need for maintaining detailed books of account. If turnover exceeds the threshold, ITR-3 with full accounting is required.
We help you maximise business expense deductions, assess presumptive taxation eligibility, and optimise your overall tax liability while ensuring full compliance.

अक्सर होने वाली गलतियाँ
Common mistakes in proprietorship ITR filing
Wrong ITR form
Business proprietors need ITR-3 or ITR-4, not ITR-1. Using the wrong form causes defective return notices.
Missing business expenses
All legitimate business expenses are deductible. Our CA ensures every eligible expense is claimed.
GST-ITR mismatch
GST turnover and ITR income must reconcile. Mismatches trigger scrutiny. We cross-check both filings.
Not claiming presumptive taxation
Section 44AD/44ADA can significantly reduce compliance burden. We assess eligibility and apply if beneficial.
Ignoring advance tax
Proprietors without TDS must pay advance tax. Missing instalments attracts interest under Section 234C.
Late filing
Late filing penalties under Section 234F apply. We ensure on-time filing every year.

सवाल-जवाब
अक्सर पूछे जाने वाले सवाल
ITR-3 if you maintain regular books of account, or ITR-4 (Sugam) if you opt for presumptive taxation under Section 44AD or 44ADA. Filing ITR-1 - meant for salaried individuals - is a common mistake that triggers a defective return notice.
It lets eligible businesses with turnover up to ₹2 crore (₹3 crore if 95%+ of transactions are digital) declare a flat 8% of turnover (6% for digital receipts) as taxable profit, without maintaining detailed books or undergoing an audit.
Section 44ADA lets professionals (consultants, freelancers, doctors, architects, etc.) with gross receipts up to ₹50 lakh (₹75 lakh if 95%+ digital) declare 50% of receipts as taxable income, similarly without detailed books.
If turnover exceeds ₹1 crore (₹10 crore with 95%+ digital transactions) for business, or gross receipts exceed ₹50 lakh for a profession, a Section 44AB audit is mandatory - unless you're within presumptive taxation limits and declare at least the prescribed percentage as profit.
Yes. A proprietorship has no separate legal identity from the proprietor, so business profit is added to any salary, rental, or other personal income and taxed together at the individual's applicable slab rate.
All expenses incurred wholly and exclusively for the business - rent, salaries, utilities, raw materials, marketing, and depreciation on business assets - are deductible under Sections 30 to 37, provided they're properly documented with invoices and receipts.
They should reconcile closely. Significant mismatches between GST returns and ITR-reported turnover are a common trigger for scrutiny notices from the Income Tax Department. We cross-check both before filing.
Yes, but if you opt out after using Section 44AD, you cannot use it again for the next 5 assessment years, and a tax audit becomes mandatory for those years if income exceeds the basic exemption limit.
Yes, if your total tax liability for the year exceeds ₹10,000. Advance tax is paid in four instalments (15 June, 15 September, 15 December, 15 March). Presumptive taxpayers under Section 44AD/44ADA can pay it in a single instalment by 15 March.
31 July if no tax audit is required, and 31 October if an audit under Section 44AB applies. Belated returns can be filed by 31 December with applicable late fees and interest.
Yes, business losses can be carried forward for 8 years and set off against future business income, but only if the return is filed by the original due date. Filing late forfeits this right.
A late fee of up to ₹5,000 under Section 234F (₹1,000 if income is below ₹5 lakh), plus interest at 1% per month on any unpaid tax under Section 234A and 234B for missed advance tax instalments.
