What is a trade license in India?

A trade license is a legal document issued by the municipal corporation or local governing body of a state, granting permission to a person or business to carry on a specific trade or commercial activity at a designated premises. It is mandated under the Shop and Establishment Act of the respective state.

The trade license ensures that the business complies with local laws, including safety codes, health regulations, zoning laws, and environmental standards. Without a valid trade license, a business cannot legally operate in most Indian states and is liable to face penalties, fines, or even closure.

Every new business - whether a small retail shop, a restaurant, a hotel, a factory, or a professional office - must apply for a trade license from the local municipal authority. The license is typically valid for one financial year and must be renewed before expiry to avoid late fees.

New trade license vs renewal vs amendment

Trade license applications come in three forms depending on whether you are starting fresh, extending an existing license, or updating details.

Process

How trade license application works

The municipal process is straightforward but varies by city. We navigate the local portal on your behalf.

1

Document verification

We verify all your documents against the specific municipal corporation's requirements. Different cities have different document checklists and formats.

2

Application filing

We fill in the municipality-specific application form online (or offline where required) with all mandatory details of the business, proprietor, and premises.

3

Fee payment

We calculate the applicable government fee based on your business category, nature of activity, and number of workers, and arrange payment.

4

Inspection (if required)

Some municipal bodies require a physical inspection of the premises before issuing the license. We schedule and follow up on inspections.

5

License issuance

Once approved, the municipal corporation issues the trade license. We download the digital certificate and deliver it to you, along with guidance on renewal dates.

You can file directly on your municipal corporation's portal for free. The reason most businesses use a service like ours is that each municipality has its own form formats, fee structures, and document requirements - getting one wrong delays the application by weeks. We know the quirks of 100+ municipalities.

Trade license vs shop and establishment registration: what is the difference?

  • Trade license and shop and establishment registration are different. A trade license is issued by the municipal corporation and permits you to carry on a specific trade at a specific premises. Shop and establishment registration is issued by the state's labour department and regulates working conditions, leave, and employee welfare. Most states now issue a combined certificate, but the underlying authorities and purposes differ.
  • Both are usually required for a new business. You typically need both: a trade license from the municipal body and a shop and establishment certificate from the labour department. Bizeneed helps with both simultaneously as part of the business setup process.
  • Renewal timelines differ. Trade licenses are usually valid for one financial year (April to March) and must be renewed before expiry. Shop and establishment certificates may have different renewal schedules depending on the state. Missing either renewal triggers penalties.
Common failure points

Common mistakes in trade license applications

Applying after starting business operations

Apply before commencing business. Operating without a valid trade license attracts penalties and can lead to premises sealing. Get the license in place before your grand opening.

Using incorrect business category in the application

Each municipality has a predefined list of business categories with corresponding fees. Choosing the wrong category leads to reapplication. We map your business to the correct category code.

Submitting incomplete address proof

The address proof must show the exact premises name/number and your name. A utility bill in the landlord's name alone is insufficient - attach the NOC and rent agreement.

Missing the renewal deadline

Set calendar reminders 30 days before expiry. Late renewals incur fees of 50-200% of the normal fee. Bizeneed sends automatic renewal reminders for all licenses we handle.

Not updating the municipality after shifting premises

A trade license is premises-specific. If you shift, you must apply for an amendment or a new license at the new premises. Continuing at a new address without updating the license is a violation.

Every rejection above has a fix - most come down to how the innovation note is written, not the business itself. Most applicants don't know that until after the rejection.

If you have already been rejected, or want to make sure it does not happen, the 15-minute call below is the fastest path.
