Statutory text

Bare law

No person except the drawee of a bill exchange, or all or some of several drawees, or a person named therein as a drawee in case of need, or an acceptor for honour, can bind himself by an acceptance.

Key rule and applicability

The permitted categories are the drawee, all or some of several drawees, a named drawee in case of need, and an acceptor for honour. Identify the actual capacity of the person purporting to accept.

Limits and related provisions

A person outside these categories cannot bind themselves by acceptance under this section merely by writing an acceptance on the bill. Any different contractual commitment requires its own legal analysis.

Hypothetical business example

Hypothetical: a supplier obtains a signature marked accepted from a business associate who is neither a drawee nor within another listed category. Section 33 requires the supplier to examine the signer’s role before treating that signature as acceptance liability.

Practical decision flow

Read the bill to identify the drawee or drawees and any named drawee in case of need.

Determine whether an acceptance for honour is involved and check its separate requirements.

Match the signer’s actual role to a permitted statutory category.
