Statutory text
Bare law
Where the acceptance does not express for whose honour it is made it shall be deemed to be made for the honour of the drawer.
Key rule and applicability
If whose honour is not expressed, the acceptance is deemed to be for the drawer’s honour. The rule resolves that omission within the acceptance-for-honour framework.
Limits and related provisions
This default does not dispense with the eligibility, consent and form requirements in sections 108 and 109. It also does not convert an unrelated promise into an acceptance for honour.
Hypothetical business example
Hypothetical: the written acceptance is generally for honour and does not identify a drawer or indorser as the beneficiary of that honour. Section 110 deems it to be for the drawer.
Practical decision flow
Read the complete acceptance declaration.
Check whether it expresses a particular person’s honour.
If it does not, use the drawer default when analysing the chapter’s further consequences.
