Statutory text

Bare law

The Controller shall, as soon as may be after the registration of a design, cause publication of the prescribed particulars of the design to be published in such manner as may be prescribed and thereafter the design shall be open to public inspection.

Introduction

Section 7 is a post-registration transparency rule. Rule 22 of the Designs Rules, 2001 provides for publication of application particulars and a design representation in the Official Gazette.

Key takeaways

1

Publication follows registration

The duty arises after registration, not merely on filing an application.

2

Prescribed particulars

Rule 22 connects publication to the application details and a representation of the article.

3

Public inspection

After publication, the registered design is open to public inspection.

Verify the published record

Compare the published design, article and registration number with the certificate and internal filing record. Keep copies for licensing and enforcement checks.

Search third-party designs

Use the public record to compare visual representations and article classes when assessing third-party rights and prior designs.

Practical checklist

Do

  • Retain the certificate and published representation.
  • Check Gazette particulars and register data before relying on a registration.

Avoid

  • Do not treat an application as a published registration.
