Statutory text

Bare law

The Controller may, in any case of doubt or difficulty arising in the administration of any of the provisions of this Act, apply to the Central Government for directions in the matter.

Rule and business relevance

The Controller may apply to the Central Government for directions in a case of doubt or difficulty concerning administration of the Act's provisions. The section explains a route available to that officer when administering the legislation.

Limits and related provisions

It is not a separate appeal filed by an applicant, a promise of an advisory ruling for any commercial question or an automatic suspension of pending deadlines. A party seeking to challenge an order must identify the applicable appeal or other legal route.

Hypothetical business example

Hypothetical: an applicant considers an examination issue difficult and asks whether Section 34 lets it appeal directly to the Government. It distinguishes the Controller's administrative reference power from its own available hearing and appeal rights.

Practical decision flow

Identify whether the issue is an administrative doubt or a challenge to a particular order.

Use the relevant proceeding to present the concern and recognise that Section 34's application is made by the Controller.

Preserve separate response and appeal deadlines unless an operative direction lawfully changes them.

Practical checklist

Do

  • Use the relevant proceeding to present the concern and recognise that Section 34's application is made by the Controller.
  • Preserve separate response and appeal deadlines unless an operative direction lawfully changes them.

Avoid

  • It is not a separate appeal filed by an applicant, a promise of an advisory ruling for any commercial question or an automatic suspension of pending deadlines. A party seeking to challenge an order must identify the applicable appeal or other legal route.
