Chapter XV - Miscellaneous
Section 75
Section 75: Orders for payment of money to be executable as a decree
Section 75 lets a qualifying order for payment of money be executed like a civil court decree once the specified certificate is issued. The printed text still refers to the former Appellate Board.

Statutory text
Bare law
Every order made by the Registrar of Copyrights or the Appellate Board under this Act for the payment of any money or by the High Court in any appeal against any such order of the Appellate Board shall, on a certificate issued by the Registrar of Copyrights, the Appellate Board or the Registrar of the High Court, as the case may be, be deemed to be a decree of a civil court and shall be executable in the same manner as a decree of such court.
Scope and applicability
Section 75 covers orders under the Act for the payment of any money. Once the certificate described in the section is issued, the order is deemed to be a decree of a civil court and can be executed in the same manner as such a decree.
The section turns on two things: an order for payment of money, and a certificate from the authority named for that kind of order. An order that does not direct payment of money is outside this section.
Current text and the 2021 amendment
Section 10(j) of the Tribunals Reforms Act, 2021 directs that the words “and the Appellate Board”, wherever they occur in sections 74 and 75, be omitted. Those exact words do not appear in section 75 as printed, so this page reproduces the printed text unchanged.
Sections 11 and 12, which designated the Appellate Board for this Act and set out its powers and procedure, were omitted by section 10(d) of the same Act, and the substituted section 72 now provides for appeals from the Registrar of Copyrights to the High Court. The printed words of section 75 refer to High Court orders in appeals against orders of the Appellate Board. They do not expressly mention an order made by the High Court in an appeal from the Registrar under the substituted section 72. Take legal advice before relying on section 75 to execute such an order.
The Copyright Office's web version of Chapter XV shows wider omissions in this section. This page does not adopt them, because the enacted amendment does not use those words.
Step-by-step review
Confirm that the order directs payment of money and identify who made it.
Check whether that kind of order falls within the printed words of section 75.
Obtain the certificate from the authority the section names for that order.
Take legal advice on the court and procedure for execution under the Code of Civil Procedure, 1908.
Hypothetical example
Hypothetical: the Registrar of Copyrights makes an order under the Act directing a party to pay money, and the payee wants to enforce it. The payee should first obtain the Registrar's certificate under section 75. With the certificate, the order is deemed to be a civil court decree and can be executed in the same manner as one.

Practical checklist
Do
- Check that the order is one for payment of money before relying on section 75.
- Obtain the certificate the section requires before starting execution.
- Take advice where the order was made by the High Court in an appeal from the Registrar.
Avoid
- Do not seek a certificate from the former Appellate Board.
- Do not treat the Copyright Office web text as the enacted wording of this section.
- Do not start execution without the certificate.
Glossary
- Certificate
- The document issued by the authority named in section 75 on which the money order is deemed to be a civil court decree.
- Decree
- Here, the status given to a qualifying money order, so that it can be executed in the same manner as a civil court decree.
Frequently asked questions
Is every order of the Registrar of Copyrights executable as a decree?
No. Section 75 applies to orders under the Act for the payment of money, and only on the certificate it describes.
Did the Tribunals Reforms Act, 2021 change the words of section 75?
Section 10(j) of that Act names section 75, but the words it omits, “and the Appellate Board”, do not appear in the printed section. The printed text therefore still mentions the Appellate Board, although the provisions constituting it were omitted.
