Facility of digital payment to recipient.—The Government may, on the recommendations of the Council, prescribe a class of registered persons who shall provide prescribed modes of electronic payment to the recipient of supply of goods or services or both made by him and give option to such recipient to make payment accordingly, in such manner and subject to such conditions and restrictions, as may be prescribed.

Introduction

A taxable-goods invoice is generally issued before or when goods are removed for supply, or on delivery or availability where they do not move. A taxable-services invoice is issued before or after provision within the prescribed period. Detailed particulars, special-category timing and electronic processes depend on current Rules or notifications.

Key takeaways

1

Goods and services have different timing rules

Goods ordinarily use removal or delivery; services use the prescribed period before or after provision. Check applicable category-specific notifications.

2

Exempt and composition supplies use a bill of supply

A registered supplier of exempt supplies or one paying under section 10 issues a bill of supply instead of a tax invoice, subject to the statutory low-value exception and Rules.

3

Advances and reverse charge have separate documents

The Act addresses receipt/refund vouchers for advances and an invoice/payment voucher for the specified reverse-charge situation involving an unregistered supplier.

4

Continuous supplies and approval goods have special triggers

Contractual payment or event dates affect continuous-service invoices; approval goods have a supply-or-six-month outer rule.

Taxable goods and services

For taxable goods, identify whether goods move and issue the invoice before or at removal, delivery or availability as subsection (1) requires. For taxable services, subsection (2) permits issuance before or after service within the prescribed period. Use current Rules for required invoice particulars and category-specific deadlines.

Alternative documents

Subsection (3) covers revised invoices after registration, a conditional small-value invoice exception, bill of supply for exempt/composition supplies, and receipt/refund vouchers for advances. The specific facts and prescribed conditions decide which document applies.

Reverse charge and recurring contracts

A registered person liable under section 9(3) or (4) issues the subsection (3)(f) invoice for goods or services from an unregistered supplier within the prescribed period and a payment voucher on payment. Continuous goods/services and early-terminated service contracts have separate timing rules in subsections (4)–(6).

Approval or sale-or-return goods

Where goods go out on approval before a supply takes place, subsection (7) requires an invoice before or at supply or six months from removal, whichever is earlier.

Practical checklist

Do

  • Classify the supply and select the statutory document before billing.
  • Record removal, delivery, service, advance and approval dates.
  • Check current Rules for particulars, prescribed service period and special notified categories.

Avoid

  • Use a taxable invoice for a composition or wholly exempt supply without checking the bill-of-supply rule.
  • Assume every advance is itself a completed supply.
  • Apply a remembered service-invoice day count without checking the current Rule.

Frequently asked questions

Before or at removal where supply involves movement, or at delivery or making available in other cases, subject to notified exceptions.

Does a composition taxpayer issue a tax invoice?
