What is Trust/NGO tax filing (ITR-7)?

Every trust, registered society, or Section 8 company that wants to claim exemption on its income under Sections 11 and 12 of the Income Tax Act must file an annual income tax return, even though its income is largely applied towards charitable or religious purposes rather than distributed as profit. This return is filed in Form ITR-7, under Section 139(4A) for charitable and religious trusts, with related sub-sections covering political parties, research associations, and other specified institutions.

The ITR-7 return reports gross receipts, income applied towards the entity's objects during the year, any income accumulated or set apart under Section 11(2) for future application, voluntary contributions received (including whether they were treated as corpus donations), and details of investments held. If the entity's total income before exemption exceeded the basic exemption limit for the year, the audit report filed as Form 10B or Form 10BB - a separate step - must be on record before the ITR-7 can be validly filed.

Filing ITR-7 is what keeps a trust or NGO's tax-exempt status active in practice, year after year. Missing the filing deadline, or filing without a required audit report already on record, can result in the exemption being denied for that year and the entity's income being assessed at normal tax rates - which is why this filing is treated as a compliance essential, not an optional formality.

Audit (Form 10B/10BB) vs Tax Filing (ITR-7): not the same thing

These two are commonly confused because they happen around the same time of year and both apply to the same entities - but they are separate filings with separate purposes.

पात्रता

Who needs to file ITR-7 as a trust or NGO?

This filing applies more broadly than the audit requirement - most active registered charitable entities need to file it every year.

  • Your entity is a registered public charitable or religious trust, a registered society, or a Section 8 company claiming exemption under Sections 11 and 12
  • You hold valid registration under Section 12A or 12AB and want to keep that exemption status active for the year
  • Your entity received voluntary contributions, donations, grants, or CSR funding during the financial year
  • Your total income, before exemption, exceeded the basic exemption limit and you have already completed (or are completing) the Section 12A(1)(b) audit
  • You need to report an accumulation of income under Section 11(2) for a specific future project
  • Your entity is registered under 80G and needs to keep its compliance record current to retain donor-certificate eligibility
  • You received a notice from the Income Tax Department for non-filing or a defective return in a prior year

प्रक्रिया

How Trust/NGO tax filing works

If your income crossed the audit threshold, the audit report needs to be filed first - we track both deadlines together.

  1. Share your financials and registration details

Send us your 12A/12AB certificate, Income & Expenditure account, Balance Sheet, and donation register for the year.

  2. We confirm whether an audit report is needed first

If your total income before exemption crossed the basic exemption limit, the Form 10B/10BB audit must be completed and its acknowledgement referenced in your ITR-7. If not, we proceed directly to return preparation.

  3. ITR-7 return prepared with correct exemption schedules

We map your income, application of income, and any accumulation under Section 11(2) into the correct ITR-7 schedules, referencing the audit report where applicable.

  4. Draft return shared for your review

You review the figures - gross receipts, application towards objects, corpus donations, and carried-forward accumulations - before anything is filed.

  5. Return filed and verified on the e-filing portal

Once confirmed, we file the ITR-7 electronically and complete verification, either via DSC or the applicable e-verification method for your entity type.

If your entity needed the Section 12A(1)(b) audit and it has not been done yet, your ITR-7 cannot be validly filed until that audit report is on record - we will flag this early rather than let you discover it near the deadline. Ask us to check both requirements together if you are not sure where your entity stands.

फ़ायदे

Why timely, correct ITR-7 filing matters

Keeps your exemption active

  • Filing ITR-7 correctly and on time is what keeps your Section 11/12 exemption valid for the year - it is not automatic just because you hold 12A/12AB registration
  • Referencing the audit report correctly avoids the return being treated as defective, which can delay or jeopardise exemption

Supports donor and grant compliance

  • CSR funders, institutional donors, and grant-making bodies routinely check your filing history before releasing or renewing funding
  • A consistent filing record supports smoother 12A/12AB and 80G renewal reviews when they come up

Avoids penalty and interest

  • Late filing under the Income Tax Act can attract late fees and interest, on top of the risk of losing the exemption itself for the year
  • Filing early also gives time to correct any discrepancy flagged by the portal before the deadline

Bizeneed क्यों

Why file your Trust/NGO tax return through us

  • Bundled Audit + ITR-7 package keeps both deadlines coordinated under one engagement
  • We track your filing history to support smoother 12A/12AB and 80G renewal reviews down the line
