What is a GST refund claim?
A GST refund is a claim to recover excess GST paid to the government. Excess payment can arise from: (1) excess ITC claimed and paid, (2) GST paid on exports where the export is zero-rated but the ITC could not be utilised, (3) inverted duty structure where the GST paid on inputs exceeds the GST collected on outputs, (4) wrong tax rate application resulting in overpayment, (5) refund of tax paid on deemed exports, (6) any other ground specified under Section 54 of the CGST Act.
Section 54 of the CGST Act, 2017 provides the framework for refund applications. The refund must be applied for within 3 years from the 'relevant date' - typically the due date of filing the relevant return (GSTR-3B) for the period in which the excess tax was paid. Missing the 3-year window means the refund claim is time-barred.
Section 56 mandates that if the refund is not sanctioned within 60 days of receiving a complete application, interest accrues at 6% per annum on the refund amount from the day after the 60-day period until the refund is actually disbursed. This interest provision is designed to incentivise timely processing, but in practice, many refunds take 6-18 months, triggering significant interest claims.
Common grounds for GST refund: which applies to you?
GST refunds can be claimed on several grounds. Understanding which ground applies to your situation is the first step.

How GST refund processing works
The refund process involves filing, verification, sanction, and disbursement. Here is the complete flow.
Assess refund eligibility and amount
Our team analyses your GSTR-3B, GSTR-2B, and books to quantify the exact refund amount. We identify the correct ground for refund (export, inverted duty, excess payment) and ensure the claim is within the 3-year time limit.
Prepare refund application
We prepare Form GST RFND-01 with the refund statement, supporting documents, and a detailed justification for the claim. For complex cases (inverted duty, export), we also prepare a CA certificate supporting the claim.
File refund application on GST portal
We file the refund application online on the GST portal. The application is routed to the jurisdictional GST officer based on your turnover and the type of refund.
Provisional sanction (if eligible)
If the application is complete, the officer may grant provisional sanction within 60 days under Section 54(14). This is typically 80-90% of the claimed amount, subject to verification.
Officer verification and final sanction
The GST officer verifies the claim against your returns, books, and supporting documents. This is where most refunds get stuck - incomplete applications, mismatched data, and missing documents cause delays or rejection.
Disbursement and interest
Once the refund is sanctioned, the amount is credited to your bank account through RTGS/NEFT. If the sanction took longer than 60 days, interest at 6% per annum accrues under Section 56 and is included in the disbursement.
The refund process looks simple on paper - file, verify, sanction, receive. In practice, the verification step is where most refunds get stuck. GST officers are under pressure to scrutinise claims, and incomplete applications, mismatched data, and missing documents are the most common reasons for delay or rejection. Our job is to make the officer's job easy so they can sanction your claim faster.
समय-सीमा
GST refund timeline
The refund process has several stages. Here is the typical timeline.
| चरण | समय |
|---|---|
| Eligibility assessment and documentation | 3-7 days |
| Refund application preparation | 3-5 days |
| Filing on GST portal | 1 day |
| Provisional sanction (if eligible) | 30-60 days |
| Final verification by GST officer | 60-180 days |
| Sanction order issuance | 1-2 weeks after verification |
| Disbursement to bank account | 7-15 days after sanction |
Simple refund cases (excess payment with clear documentation) typically complete in 60-90 days. Complex cases (inverted duty structure, export refunds) can take 6-12 months. Interest accrues at 6% per annum from the 61st day if the refund is not sanctioned within 60 days of the complete application.

फ़ायदे
Why claiming your GST refund matters
Recover excess payments
- Excess GST paid is your money - the government holds it without interest for up to 60 days(Section 54 - Refund provisions)
- Interest at 6% per annum under Section 56 compensates for delays beyond 60 days(Section 56 - Interest on delayed refunds)
- Recovered refunds improve your cash flow - often lakhs of rupees tied up with the GST department
Legal entitlement
- You have a legal right to a refund under Section 54 - it is not a favour from the GST department(Section 54(1))
- The 3-year time limit is strict - file before it expires or the claim is time-barred permanently(Section 54(9))
- If the refund is wrongly rejected, you can appeal before the Appellate Authority
Export competitiveness
- For exporters, timely GST refund recovery keeps your export pricing competitive - GST-inclusive costs erode margins(IGST Act - Zero-rated supplies)
- SEZ units rely on timely refunds to maintain working capital(SEZ Act read with GST Act)
- Inverted duty structure refunds are critical for manufacturing exporters with high input tax
The refund process pitfalls and how to avoid them
- Incomplete documentation is the #1 cause of refund rejection. A refund application with even one missing document is typically returned as 'incomplete' by the GST officer. The officer does not call you to ask for the missing document - they simply mark it incomplete and the clock keeps running. Our team prepares a complete, officer-ready application package so your refund does not get stuck at the first step.
- The 3-year time limit is non-negotiable. Section 54(9) states that no refund shall be granted if the application is made after 3 years from the relevant date (typically the due date of GSTR-3B for the period in which the excess was paid). This is a strict time bar. Condonation of delay is not generally available for refund claims. We track the time limit from the moment we assess your claim.
- Interest under Section 56 is your right. If the refund is not sanctioned within 60 days of a complete application, interest accrues at 6% per annum from the day after the 60th day. Many GST officers do not mention this interest in the sanction order, leaving it to you to claim it. We calculate and claim the interest explicitly in every refund application, so you get every rupee you are entitled to.
अक्सर होने वाली गलतियाँ
Common GST refund mistakes
Filing refund application without complete documents
We prepare a complete document package before filing. A rejected-application cycle adds 3-6 months to your timeline.
Missing the 3-year time limit
We track the relevant date for every potential refund claim and file well within the window.
Not claiming interest under Section 56
Interest accrues automatically from day 61. We include it in every refund application and claim it explicitly.
Confusing 'provisional' with 'final' refund
Provisional sanction (80-90% of claim) is not the final refund. The officer still verifies and may adjust the final amount. Track the final sanction order.
Not following up on pending refunds
Refund applications can sit with the officer for months. We track every application and follow up systematically.
Filing refund for time-barred amounts
The 3-year limit applies from the due date of GSTR-3B for the specific period. Check before filing - a time-barred claim is a waste of effort.

A pharma exporter with ₹15 crore turnover had accumulated ₹28 lakh in unutilised ITC over 18 months due to zero-rated export supplies. Their previous accountant had filed a refund application with incomplete documentation - it was returned as incomplete twice and the 3-year window was closing. We took over the case, prepared a complete application with CA certification, filed it within the remaining time, and tracked it through verification. The refund of ₹28 lakh plus ₹4.2 lakh in Section 56 interest was sanctioned and disbursed in 95 days.
सवाल-जवाब
अक्सर पूछे जाने वाले सवाल
A GST refund is a claim to recover excess GST paid to the government. It can arise from: excess ITC claimed and paid, GST paid on exports where ITC could not be utilised, inverted duty structure (where input tax exceeds output tax), wrong tax rate application, or any other excess payment. Refunds are governed by Section 54 of the CGST Act, 2017.
Under Section 54(9) of the CGST Act, a refund application must be filed within 3 years from the 'relevant date'. The relevant date is typically the due date of filing GSTR-3B for the period in which the excess tax was paid. For example, if excess tax was paid in March 2024, the relevant date is 20th April 2024, and the refund must be claimed by 20th April 2027. This time limit is strict and generally not condonable.
Under Section 56 of the CGST Act, if a refund is not sanctioned within 60 days of receiving a complete application, interest accrues at 6% per annum on the refund amount from the day after the 60th day until the refund is actually disbursed. This interest is your legal right - the GST department is obligated to pay it for delays beyond 60 days. We calculate and claim this interest in every refund application.
Common grounds for GST refund under Section 54: (1) Export of goods/services with zero-rated supply and excess ITC, (2) Supply to SEZ units with zero-rated supply, (3) Inverted duty structure (input tax rate > output tax rate), (4) Excess GST paid due to wrong rate or classification, (5) Refund of tax paid on deemed exports (EOU/STP/BTP), (6) Excess ITC accumulated due to lower output tax, (7) Refund of pre-deposit made during appeal.
The GST law mandates that refunds be sanctioned within 60 days of receiving a complete application (with provisional sanction of 80-90%). However, in practice: simple refunds (excess payment with clear documentation) take 60-90 days, export refunds take 90-180 days, inverted duty structure refunds take 6-12 months (they require detailed CA certification and officer scrutiny), and complex or disputed refunds can take 12-24 months including appeals.
If your refund application is rejected, you receive a rejection order from the GST officer. You can appeal this order before the Appellate Authority under Section 107 of the CGST Act within 3 months of the rejection order. The appeal must include the grounds for challenging the rejection, supporting evidence, and the pre-deposit of 10% of the disputed amount. We handle refund appeals with the same CA + Advocate team that handles GST appeals.
Yes. If you have accumulated ITC that you could not utilise because your output tax liability was lower, you can claim a refund of the excess ITC under Section 54(1). However, this is subject to the 3-year time limit. The refund amount is calculated as the excess ITC at the end of the financial year, and the application must be filed before the expiry of the time limit.
Export GST refund requires: (1) Shipping bill / bill of export, (2) Foreign Inward Remittance Certificate (FIRC) or export realisation proof, (3) Export invoice and packing list, (4) Letter of Credit / Advance Payment proof, (5) GSTR-1 showing zero-rated export supplies, (6) GSTR-3B for the relevant months, (7) ITC reconciliation for the exported goods, (8) GST RFND-01 application with detailed refund statement.
Provisional sanction under Section 54(14) allows the GST officer to sanction up to 80% (or 90% in certain cases) of the claimed refund amount on a provisional basis while the full verification is ongoing. This is intended to provide interim relief to the taxpayer. The provisional amount is paid first, and the balance is paid after final verification. However, many officers do not grant provisional sanction for complex refunds (inverted duty, export), so do not rely on it as guaranteed.
Inverted duty structure refund is available when the GST rate on your inputs (purchases) is higher than the GST rate on your outputs (sales). In this situation, you accumulate ITC that you cannot utilise because your output tax liability is lower. Section 54(1) allows you to claim a refund of this excess ITC. The formula is: Refund = [{(ITC on input tax and input services) − (0.1 × ITC on input tax)} / {(Output tax payable on inward supply of goods) − (0.1 × Output tax payable on inward supply of goods)}] × Net GST payable. This requires detailed documentation and a CA certificate.
Yes. You can track your refund status on the GST portal under Services > Refunds > Track Refund Status. You will need your GSTIN and the application number (ARN) that you received after filing. The status shows: application received, under verification, provisional sanction (if any), final sanction, or rejection with reason. We also track every refund application we file and provide you with regular status updates.
A refund (Section 54) is the recovery of excess tax paid to the government - it comes back to you because you paid too much. A rebate (Section 15) is a reduction in the price of goods/services where the supplier bears the GST cost - the consumer pays less upfront. In a refund, the tax is paid first and recovered later. In a rebate, the tax is never charged or is reduced at the point of sale. The two are fundamentally different mechanisms with different legal provisions.
Yes. If a taxpayer has passed away, the legal heir or legal representative can claim the GST refund on behalf of the deceased. The legal heir must provide: (1) death certificate of the taxpayer, (2) legal heir certificate or succession certificate, (3) their own GST registration (if applicable), and (4) all other documents required for the refund claim. The refund, if sanctioned, is paid to the legal heir's bank account.
If the refund is not sanctioned within 60 days of receiving a complete application, interest accrues at 6% per annum under Section 56. You do not need to separately apply for this interest - it accrues automatically and should be included in the disbursement. If the department still does not disburse the refund (with interest), you can file a writ petition in the High Court for mandatory directions to release the refund. Our team handles both the interest claim and the escalation if needed.
Yes. You can withdraw a refund application at any stage before the final order is passed, using Form GST RFND-03 on the GST portal. Withdrawal may be appropriate if: (1) you have rectified the excess payment through GSTR-3B amendments, (2) the refund amount is very small and not worth the effort, (3) you have reached a settlement with the GST officer. However, if you withdraw and the 3-year time limit expires, you cannot re-file.
