Frequently asked questions
TDS (Tax Deducted at Source) is a mechanism where tax is deducted at the time of making certain payments. The deductor deducts tax and deposits it with the government, and the deductee can claim credit for the TDS.
TDS rates vary by section: Salary (192) - as per slab rates; Interest (194A) - 10%; Rent (194I) - 10%; Contractor (194C) - 1% (individual/HUF) or 2% (others); Professional fees (194J) - 10%.
Any person making specified payments to residents must deduct TDS. This includes employers, banks, contractors, and businesses making payments for rent, professional fees, commissions, interest, etc.
Form 26Q is the quarterly TDS return for payments other than salary. It must be filed quarterly by all deductors and contains details of all TDS deductions made during the quarter.
Form 16 is issued by employers to employees showing salary paid and TDS deducted. It has two parts - Part A (employer details, salary, TDS summary) and Part B (detailed salary breakup, tax computation).
TDS on sale of immovable property (other than agricultural land) is 1% under Section 194IA if the sale consideration exceeds ₹50 lakh. The buyer must deduct TDS and deposit it with the government.
Form 16A is issued for TDS on non-salary payments like interest, rent, professional fees, and contractor payments. It serves as proof of TDS deducted for the deductee.
If excess TDS is deducted, you can claim a refund by filing your income tax return. The excess TDS amount will be refunded after processing of your return.
TDS on cash withdrawal under Section 194N is 2% (if cash withdrawal exceeds ₹1 lakh) or 5% (if exceeds ₹2 lakh) for individuals, and 2% or 5% (with higher limits) for businesses.
You can check TDS credit by viewing Form 26AS on the TRACES portal or through your net banking. Ensure the deductor has correctly deposited the TDS and filed returns.
TDS on rent under Section 194I is 10% for rent exceeding ₹2.4 lakh per year for individuals/HUF, and 2% for plant/machinery hire, 10% for other rent. No TDS for rent below ₹2.4 lakh.
Form 27Q is the quarterly TDS return for payments made to non-residents (excluding salary). It must be filed by deductors making payments like interest, royalty, or technical services to foreign payees.
TDS on salary under Section 192 is deducted based on the employee's income tax slab rates. The employer calculates TDS considering all declared investments and deductions before deducting tax monthly.
Form 15G is for individuals below 60 years and Form 15H for senior citizens (60+) to request no TDS deduction on interest income if total income is below the taxable limit.
