Rule breakdown

Choose the correct form and category

Apply in Form No. 18 for the specified affordable housing project, or Form No. 19 for the specified semiconductor wafer fabrication unit. The application is addressed to Member (IT), CBDT at the stated Ministry address.

Confirm that the project is within the particular section 46 business category. A broad property-development or electronics-business description does not itself satisfy these notification conditions.

Application deficiencies and the decision

A deficiency letter may be served for defects or missing relevant documents. The applicant must remedy it within one month from the end of the month of service; the Board may treat the application as invalid if the deficiency remains.

The Board may seek further information, notify approval or reject with recorded reasons. A hearing opportunity is required for the listed adverse decisions, and the order is communicated to the applicant and jurisdictional tax authorities.

Accounts and timely returns

Maintain separate books with complete details of capital expenditure for the tax year of the intended section 46 claim and file the relevant returns by the due date.

Notification should be read with the Act’s deduction conditions. The rule continues to govern a notified project or unit to the extent it does not contravene the Act.

Affordable housing: sanction, land and area mix

The housing project needs prior sanction under the stated Affordable Housing in Partnership scheme, the prescribed design/layout approval and a plot of at least one acre. Its defined commencement date must be on or after 1 April 2011.

Of total allocable rentable area, at least 30% is for EWS, at least 60% cumulatively for EWS and LIG, and at least 90% cumulatively for EWS, LIG and MIG. The remaining 10% or less may be other residential or commercial units. These are nested thresholds, not percentages to add together.

Housing unit sizes and completion period

Apply the separate specified-city and other-city limits in the table. Check the defined rentable area, housing unit and total allocable rentable area; the latter excludes common facilities and services.

The housing project must be completed within five years from the end of the tax year in which the competent authority sanctions it. For this category, commencement is defined by sanction, not the first sale of a unit.

Semiconductor units have different requirements

The unit must exclusively manufacture semiconductor wafer fabrications, have the specified competent-authority approval under the stated incentive scheme and begin commercial production on or after 1 April 2014. All its manufacturing facilities must be in India.

Use the rule’s specified National Industrial Classification definition. The housing area mix and completion-period conditions should not be imported into the semiconductor-unit test.

Monitor approval and withdrawal conditions

The Board may withdraw approval for the listed cessation, genuineness or condition failures. For a semiconductor unit, withdrawal of the specified competent-authority approval is an additional stated ground.

Retain the underlying approvals and monitor changes to them alongside the tax notification, accounts and return filings.

Illustrative housing-area check

Hypothetical: total allocable rentable area is 10,000 square metres. At least 3,000 must fall in EWS, at least 6,000 in EWS and LIG together, and at least 9,000 in the three specified categories together.

These figures only illustrate the area ratios. Unit sizes, plot size, sanctions, dates and the other statutory requirements must also be satisfied.

Key takeaways

Separate forms

Housing uses Form 18; semiconductor units use Form 19.

Nested housing ratios

The 30%, 60% and 90% tests are cumulative category thresholds.

Different commencement tests

Housing uses its defined sanction date; the unit uses commercial production.

Continuing conditions

Separate books, timely returns and approvals remain relevant.

Practical checklist

  • Identify the correct category and form.
  • Keep approvals and the separate expenditure books.
  • Measure housing areas using the rule’s definitions.
  • Track return deadlines and changes to underlying approvals.

Avoid

  • Do not add the nested housing percentages.
  • Do not apply housing-specific tests to the semiconductor category.
  • Do not equate application with notification.

FAQs

Are the 30%, 60% and 90% housing ratios added together?

No. They are thresholds for EWS alone, EWS plus LIG, and EWS plus LIG plus MIG respectively.

What is the minimum housing-project plot area?

At least one acre under sub-rule (5)(c).

May a semiconductor unit have facilities outside India under this condition?

No. Sub-rule (6)(d) requires all facilities of the unit to be located in India.

Is housing commencement defined as the first sale?

No. Sub-rule (7)(b) defines it by sanction from the specified competent authority.
