Rule 33 - Conditions subject to which approval is to be granted to a research association for deduction for expenditure on scientific research under section 45(4) read with section 45(3)(a)

(1) The sole object of the applicant research association shall be to undertake scientific research or research in social science or statistical research, as the case may be.

(2) The applicant research association shall carry on the research activity by itself.

(3) The research association seeking approval under section 45(4)(b) shall–– (a) maintain books of account; (b) get such books audited by an accountant as defined in the section 515(3)(b); and (c) furnish the report of such audit duly signed and verified by such accountant to the Commissioner of Income-tax having jurisdiction over the research association, by the due date of furnishing the return of income under section 263(1).

(4) The research association shall maintain a separate statement of donations received and amount applied for scientific research or research in social science or statistical research and a copy of such statement duly certified by the auditor shall accompany the report of audit referred to in sub-rule (3).

(5) The research association shall, by the due date of furnishing the return of income under section 263(1), furnish a statement to the Commissioner of Income-tax containing— (a) a detailed note on the research work undertaken by it during the tax year; (b) a summary of research articles published in national or international journals during the tax year; (c) any patent or other similar rights applied for or registered during the tax year; and (d) programme of research projects to be undertaken during the forthcoming tax year and the financial allocation for such programme.

(6) If it is found by the Commissioner of Income-tax that the research association,— (a) is not maintaining books of account; or (b) has failed to furnish its audit report; or (c) has not furnished its statement of the sums received and the sums applied for scientific research or research in social science or statistical research or a statement referred to in sub-rule (5); or (d) has ceased to carry on its research activities, or its activities are not genuine; or (e) is not fulfilling the conditions subject to which approval was granted to it, he may, after making appropriate enquiries, furnish a report on the circumstances referred to in clauses (a) to (e), to the Central Government within six months from the date of furnishing the return of income under section 263(1).

Rule breakdown

Check the sole object and the actual activity

The association’s sole object must be the relevant scientific, social-science or statistical research. It must carry on the research activity itself.

Review both the governing objects and the work actually undertaken. A research label in the entity’s name does not demonstrate the sole-object and activity requirements.

Maintain books and obtain the defined audit

The association seeking approval must maintain books and have them audited by an accountant as defined in section 515(3)(b). The signed and verified audit report goes to its jurisdictional Commissioner by the section 263(1) return due date.

Retain the accounts, engagement and filed report so the annual requirement can be demonstrated. The report deadline is linked to the applicable return due date.

Keep the donation and application statement

Maintain a separate statement of donations received and amounts applied to the stated research activities. An auditor-certified copy accompanies the audit report.

Reconcile donations and their application to the books. A receipt total alone does not show how the funds were applied.

Prepare the annual research statement

By the return due date, furnish the research note, summary of published journal articles, patents or similar rights applied for or registered, and the forthcoming research programme with its financial allocation.

These are separate information categories. Record a supported nil position where a category has no activity rather than omitting it from the review file.

Understand reporting of non-compliance

After appropriate inquiry, the Commissioner may report the listed failures to the Central Government within six months of furnishing the return. The triggers include missing books or reports, missing statements, cessation or non-genuine research, and breach of approval conditions.

Keep annual reporting and actual research evidence together. The Commissioner’s report is a statutory follow-up step; the approval procedure and any withdrawal action must be read with Rule 32.

Key takeaways

Sole research object

Check both the governing object and own research activity.

Accounts and funds

Books, audit and the certified donation-application statement are separate requirements.

Research reporting

The annual statement covers current work, publications, rights and next-year plans.

Practical checklist

  • Check the governing objects and actual research work.
  • Reconcile the donation-application statement to the accounts.
  • Submit all annual information categories by the linked deadline.

Avoid

  • Do not treat approval as ending annual obligations.
  • Do not substitute only a donation total for the application statement.
