Rule 31 - Furnishing of statement of particulars in respect of donation and certificate to donor under section 45(4)(a)

(1) For the purposes of section 45(4)(a), the deduction in respect of any sum paid to the research association, University, college or other institution referred to in 45(3)(a) or the company referred to in 45(3)(b) shall not be allowed, unless such research association, University, college or other institution or company–– (a) prepares statement in Form No. 15 for each tax year and deliver or cause to be delivered to the Director General of Income-tax (Systems) or the person authorised by him; and (b) furnish to the donor, a certificate specifying the amount of donation in Form No. 16

(2) The research association, University, college or other institution or company shall, while aggregating the amounts for determining the sums received for reporting in respect of any person, — (a) take into account all the donations of the same nature paid by that person during the tax year; and (b) proportionately attribute the value of the donation or the aggregated value of all the donations to all the persons, in a case where the donation is recorded in the name of more than one person and where no proportion is specified by the donors, attribute equally to all the donors.

(3) The person who is authorised to verify the return of income under section 265 shall verify Form No. 15.

(4) Statement of particulars in Form No. 15 and the certificate to the donor in Form No. 16 shall be furnished on or before the 31st May, immediately following the tax year in which the donation is received.

Introduction

The rule is a condition linked to the deduction for the specified research payments. The recipient’s reporting and certification must be reviewed alongside the separate substantive requirements of section 45.

Rule breakdown

Identify the covered research recipient

The rule concerns sums paid to the research association, University, college or other institution referred to in section 45(3)(a), or the company referred to in section 45(3)(b). It is not the general form prescription for every charitable contribution.

For this condition, the stated deduction is not allowed unless the recipient prepares and delivers the annual Form No. 15 statement and furnishes the donor’s Form No. 16 certificate. Check recipient identity and the underlying section 45 eligibility separately.

Prepare the statement and donor certificate

Form No. 15 is delivered to the Director General of Income-tax (Systems) or the authorised person. Form No. 16 specifies the donation amount and is furnished to the donor. Keep the recipient, tax year and donation particulars consistent across the records.

Form numbers have a specific context here. This rule’s donor certificate should not be confused with an employment salary certificate merely because the number is familiar from another tax framework.

Aggregate the relevant amounts

When reporting for a person, include all donations of the same nature paid by that person during the tax year. Reconcile repeated payments to avoid reporting an annual figure that omits a later receipt or counts the same payment twice.

The rule refers to donations of the same nature. Preserve the classification and source records supporting the aggregation rather than treating every unrelated transaction as a donation.

Allocate jointly recorded donations

Where the donation is recorded in more than one person’s name, attribute its value or aggregated value proportionately. If donors specify no proportion, attribute equally to all donors.

Hypothetical: a ₹90,000 donation is recorded jointly for three donors without specified proportions. Rule 31 allocates ₹30,000 to each. If an applicable proportion is specified, use that proportion instead of automatically dividing equally.

Verification and the 31 May deadline

The person authorised to verify the return of income under section 265 verifies Form No. 15. Both the statement and the donor certificate must be furnished on or before 31 May immediately following the tax year in which the donation is received.

For donations received in tax year 2026–27, that stated annual deadline is 31 May 2027, subject to checking any applicable official extension. It is not calculated separately as twelve months from each individual donation date.

Recipient and donor reconciliation

The recipient should reconcile receipts, donor attribution, the annual statement, certificate values and submission evidence. The donor should retain the certificate and payment records and check its own deduction conditions.

A certificate does not by itself resolve every eligibility condition under section 45, and the reporting requirement should not be omitted merely because a payment receipt already exists.

Key takeaways

Two different documents

The recipient delivers Form 15 to the specified Systems authority and Form 16 to the donor.

Aggregate by donor and nature

Take account of donations of the same nature from the same person during the tax year.

Common annual deadline

Both documents are due by 31 May immediately following the tax year of receipt.

Practical checklist

  • Reconcile same-nature receipts for each donor.
  • Document joint-donor proportions or the equal split.
  • Use the section 265 verifier and track both 31 May obligations.

Avoid

  • Do not apply the form prescription indiscriminately to every charity.
  • Do not report the entire jointly recorded amount against every donor.
  • Do not confuse a payment receipt with the required donor certificate.
