Rule 112 - Amendments to application

(1) An applicant may request in writing for an amendment to an application at any stage, before the finalisation of the terms of the agreement.

(2) The Principal Chief Commissioner of Income-tax (International Taxation) (for unilateral agreement) or the competent authority of India (for bilateral or multilateral agreement) may, allow the amendment to the application, if such an amendment does not have effect of altering the nature of the application as originally filed.

Rule breakdown

Request the amendment before terms are finalised

The request must be in writing and can be made at any stage before finalisation of the agreement’s terms. Identify the original application and the exact proposed change.

This procedure concerns a pending application; revising an executed agreement is dealt with separately.

The authority must allow the amendment

For unilateral cases the designated Principal Chief Commissioner may allow it; for bilateral or multilateral cases the competent authority of India may do so.

A submitted request is not self-executing permission. Keep the authority’s decision with the application file.

Preserve the nature of the original application

The condition is that the amendment must not alter the nature of the application originally filed. Explain why the proposed correction or update is consistent with the original scope and purpose.

Where changes materially reshape transactions, parties or agreement type, obtain a procedural assessment rather than assuming this short provision authorises them.

Maintain an audit trail of the changes

Provide a clear comparison of original and proposed wording and identify supporting documents affected by the change. Keep versions consistent across the form, factual submissions and pricing analysis.

Record the date requested and any permission or conditions so later discussions use the correct version.

FAQs

Does a written request automatically amend the application?

Can this rule revise an already executed APA?
