Rule 101: Business safe harbour Form 49 procedure

Rule 101 governs the business-income attribution safe harbour option and requires complete Form 49 before the relevant section 263 return. First review the separate conditional diamond-sale and component-storage exemptions effective from 1 October 2026; choosing safe harbour is not a substitute for checking the current Act.

Rule 101 - Procedure governing safe harbour rules for income attribution in case of income from business and profession

(1) For exercising option for safe harbour, the assessee shall furnish Form No. 49, complete in all respects, to the Assessing Officer before furnishing the return of income under section 263 for the relevant tax year.

(2) The income from eligible business shall be determined in accordance with the provisions of the Act without having regard to the provisions of rule 100(2), where the assessee does not exercise option for safe harbour under rule 100(1).

(3) The Assessing Officer may declare the option for safe harbour as invalid by an order in writing, where the assessee has— (a) availed the safe harbour by furnishing incorrect facts; or (b) concealed facts related to his business.

(4) The Assessing Officer shall afford a reasonable opportunity of being heard to the assessee before declaring the option for safe harbour invalid under sub-rule (3).

(5) The Assessing Officer shall serve a copy of the order referred to under sub-rule (3) to the assessee and the other provisions of the Act shall apply accordingly.

(6) Form No. 49 shall be furnished electronically either under digital signature or through electronic verification code and shall be verified by the person who is authorised to verify the return of income of the assessee under section 265.

Introduction

This rule works with Rule 99’s definitions and Rule 100’s margins and deduction consequences. It does not use the same return/form filing sequence as the domestic-transaction procedure in Rule 98.

Rule breakdown

Review the current Act before electing safe harbour

From 1 October 2026, Schedule IV entries 13F and 13G of the Income-tax Act provide separate conditional exemptions for the specified rough-diamond sale income and component-storage income available on sale of components. Check those current Act provisions before choosing this income-attribution safe harbour. The new exemptions do not amend the quoted Rules 99–102 or automatically make every diamond or warehouse receipt exempt.

Identify the income and taxpayer category, verify every applicable exemption condition and prescribed-information obligation, and then decide the appropriate return and option treatment. The statutory exemptions and the Rule 101 election are distinct questions. Neither filing Form 49 nor declining safe harbour by itself establishes an exemption.

Both new entries are effective from 1 October 2026 and state availability up to the tax year ending 31 March 2041, subject to their conditions. Keep the effective date, receipt or transaction facts and required information under review. Form 49 is a safe harbour option form; do not assume it also satisfies the separate exemption’s prescribed-information requirement.

Step 1: establish eligibility and calculate the proposed income

Review the current conditional Act exemptions first. Where the safe harbour option is being considered, complete the Rule 99 eligibility analysis and Rule 100 computation, and keep the contracts, zone or warehouse evidence and gross-receipt workings.

Step 2: furnish Form 49 before the return

The form must be complete and furnished to the AO before the relevant tax-year return under section 263. Sub-rule (6) requires electronic furnishing under digital signature or electronic verification code and verification by the authorised section 265 person. Retain the form acknowledgment and the later return acknowledgment.

Step 3: present accurate business facts

The AO may invalidate the option by written order if the safe harbour was availed on incorrect facts or facts related to the business were concealed. Maintain the documents supporting the facts reported in the form and respond accurately in any proceedings.

Hearing and order service

Before invalidating the option, the AO must afford a reasonable opportunity of being heard. A copy of the invalidity order must be served on the assessee, after which the other provisions of the Act apply accordingly.

If the option is not exercised

Income is determined under the Act without Rule 100(2)’s margin table. This includes assessing any applicable current Act exemption; it does not mean the gross receipts or a fixed margin are automatically taxable.

Key takeaways

Current exemption check first

Schedule IV entries 13F and 13G provide separate conditional exemptions from 1 October 2026; they do not change this rule’s quoted text.

File the form before the return

Rule 101(1) expressly places complete Form 49 before the relevant section 263 return.

Electronic filing and verification

Use digital signature or electronic verification code; the verifier must be authorised under section 265.

Facts must be accurate

Incorrect facts or concealed facts related to the business are the stated invalidity grounds.

No option means ordinary computation

Without the option, the Act determines income without Rule 100(2)’s margin table; that analysis includes any applicable current exemption.

Practical checklist

  • Check current Schedule IV entries 13F and 13G, their effective date and prescribed-information conditions before choosing safe harbour.
  • Finish the eligibility and margin checks before filing.
  • File complete Form 49 electronically before the return.
  • Preserve accurate business evidence and both acknowledgments.
  • Review the served order and available Act remedies if invalidity arises.

Avoid

  • Do not reverse the express form-before-return sequence.
  • Do not assume Rule 98’s objection deadlines apply to Rule 101.

FAQs

When must Form 49 be filed under Rule 101?

Before furnishing the return under section 263 for the relevant tax year. The rule also requires electronic furnishing and verification by the authorised person.

Can the AO invalidate the option without a hearing opportunity?

Rule 101(4) requires a reasonable opportunity of being heard before an invalidity declaration under sub-rule (3).

What if no safe harbour option is exercised?

Sub-rule (2) applies the Act without Rule 100(2)’s table. Assess the current Act, including any applicable conditional exemption, rather than assuming a safe harbour margin applies automatically.

Does the October 2026 amendment make every diamond or component-storage receipt exempt?

No. The separate Schedule IV exemptions have defined taxpayer, transaction, goods, information and timing conditions. Assess them independently of the unchanged safe harbour rules.
