What is Factory License?

Factory license is a registration required under the Factory Act, 1948 for any premises where manufacturing activities are carried out with 10 or more workers (with power) or 20 or more workers (without power). The license ensures compliance with worker safety, welfare, and working conditions.

The Factory Act, 1948 regulates various aspects of factory operations including health, safety, welfare, working hours, leave provisions, and employment of women and young persons. Non-compliance can result in serious penalties and even imprisonment.

The Factory Act, 1948 is an Indian labour law that regulates the conditions of work in manufacturing establishments. It ensures the health, safety, and welfare of workers in factories.

Any premises where 10 or more workers (with power) or 20 or more workers (without power) are employed in a manufacturing process needs factory registration under the Factory Act.

Factory registration is under the Factory Act for manufacturing units. Shop and establishment registration is under the respective state's Shop and Establishment Act for commercial establishments (retail, offices, etc.).

Consent to Establish (CTE) is permission to set up a factory from the Pollution Control Board. Consent to Operate (CTO) is permission to start operations. Both are mandatory for manufacturing units.

Boiler license under the Indian Boilers Act is mandatory for steam boilers used in factories. It ensures safe operation of boilers and is issued by the Chief Inspector of Boilers.

The Factory Act mandates canteen, restrooms, first aid boxes, drinking water, washing facilities, creche (for factories with 30+ women workers), and other welfare measures.

Adult workers cannot work more than 48 hours a week. Daily work cannot exceed 9 hours. Overtime is paid at double the rate. Weekly holidays are mandatory.

Form 2 is the application for factory license/registration. It contains details of the factory, owner, workers, machinery, and manufacturing process. It must be filed before starting operations.

Hazardous factories are those manufacturing or handling flammable, explosive, or toxic substances. They require additional safety measures, higher insurance, and more frequent inspections.

Factory license is specific to the owner and location. If the owner changes or the factory shifts location, a new application must be filed.

Factories must file annual returns with the Chief Inspector showing worker details, working hours, leave, accidents, and other operational details. Non-filing attracts penalties.

Operating without factory registration can attract imprisonment up to 2 years and/or fines up to ₹1 lakh. The Chief Inspector can also direct closure of the factory.

Form 2 is the application for factory registration/license. It contains details of the factory, owner, workers, machinery, and manufacturing process. It must be filed before starting operations.

Boiler license under the Indian Boilers Act is mandatory for steam boilers used in factories. It ensures safe operation and is issued by the Chief Inspector of Boilers after inspection and testing.

Fire safety NOC from the Fire Department is mandatory for factory license. It certifies that the factory premises meet fire safety standards including fire extinguishers, exits, alarms, and emergency evacuation plans.
