These Terms and Conditions govern the individual income tax return (ITR) filing services offered by Bizeneed to individual taxpayers, professionals, and salaried persons across India. These Terms are framed in strict accordance with the Information Technology Act, 2000, the Indian Contract Act, 1872, the Income Tax Act, 1961, and all other applicable Indian laws. By engaging our ITR filing services, you acknowledge that you have read, understood, and agree to be bound by these Terms in their entirety.

Introduction

Welcome to Bizeneed India Private Limited. These Terms and Conditions govern the individual income tax return (ITR) filing services offered by Bizeneed to individual taxpayers, professionals, and salaried persons across India. These Terms are framed in strict accordance with the Information Technology Act, 2000, the Indian Contract Act, 1872, the Income Tax Act, 1961, and all other applicable Indian laws and regulations. By engaging our ITR filing services, you agree to be bound by these Terms in their entirety. If you do not agree with any provision of these Terms, you must discontinue the use of our services immediately.

  • These Terms apply to all individual users availing ITR filing services through the Bizeneed platform
  • Bizeneed acts as a technology-enabled intermediary connecting individual taxpayers with qualified Chartered Accountants and tax professionals
  • By submitting an engagement request, you confirm that you have read, understood, and agree to these Terms
  • If you are filing on behalf of another individual, you represent that you have the authority to do so
  • Continued engagement after any modifications to these Terms constitutes acceptance of the updated Terms

Scope

Bizeneed's individual ITR filing services cover the preparation, verification, and e-filing of income tax returns for individual taxpayers under the applicable provisions of the Income Tax Act, 1961. Our services include assistance with ITR-1 (Sahaj) for salaried individuals with income up to specified limits, ITR-2 for individuals and HUFs with income from sources other than business or profession, ITR-3 for individuals and HUFs having income from a proprietary business or profession, ITR-4 (Sugam) for presumptive income from business and profession, ITR-5 for LLPs and AOPs, ITR-6 for companies other than those claiming exemption under Section 11, and ITR-7 for persons including companies required to file returns under specific sections. Additional services include tax planning and advisory, intimation and notice handling under Sections 143(1), 143(2), and 148, advance tax computation and payment assistance, and tax deduction at source (TDS) reconciliation and filing support.

Client Obligations

As a client availing individual ITR filing services, you are required to provide all necessary documents, information, and declarations accurately and within the timelines communicated by Bizeneed. You must ensure that all information submitted for tax filing is true, complete, and verifiable. You are solely responsible for the correctness and completeness of all information and documents provided. Any incorrect, incomplete, or misleading information may result in penalties, prosecution, or adverse legal consequences under the Income Tax Act, 1961. You agree to promptly notify Bizeneed of any changes to your personal information, financial circumstances, or tax status that may affect your tax return.

  • Provide Form 16 issued by your employer(s) for the relevant assessment year
  • Submit Form 26AS and AIS (Annual Information Statement) downloaded from the income tax portal
  • Provide bank statements, interest certificates, and savings account interest details
  • Submit all investment proofs (Section 80C, 80D, 80G, 80CCD, 24(b), etc.) for claiming deductions
  • Disclose all income sources including salary, house property, capital gains, business income, and other sources
  • Provide rental income details, property purchase/sale documents, and capital gains computation records
  • Submit details of foreign assets, foreign income, and international travel as applicable
  • Review and confirm the draft return before e-filing
  • E-sign or provide digital signature for e-filing of the tax return

Fees & Payment

Service fees for individual ITR filing are as communicated at the time of engagement and become binding upon acceptance by you. Fees vary based on the type of ITR form, complexity of income sources, and additional services required such as tax notice handling, tax audit support, or capital gains computation. All fees are quoted exclusive of applicable GST and any government fees, which shall be charged additionally. Payment is due upon engagement confirmation and before the commencement of service delivery unless otherwise agreed in writing. Late payments may attract interest at 18% per annum or the maximum rate permitted under applicable law. We reserve the right to withhold filing or related services for overdue payments exceeding 15 days.

  • Service fees vary based on ITR type, income complexity, and additional services required
  • All fees are quoted exclusive of applicable GST unless explicitly stated otherwise
  • Government fees (if any) and out-of-pocket expenses are billed separately
  • Payment is due upon engagement confirmation and before service commencement
  • Late payments attract interest at 18% per annum from the due date until actual payment
  • Services may be withheld for accounts with overdue payments exceeding 15 days
  • Additional charges apply for rework due to incorrect or incomplete information provided by the client
  • Fees for post-filing services (notice handling, revised returns, etc.) are billed separately

Timelines

Standard turnaround time for individual ITR filing services is between 10 to 30 days from the date of receipt of all required documents and complete information. The actual timeline may vary depending on the complexity of income sources, the type of ITR form, availability of complete documentation, response time for clarifications, and workload at the time of filing. Rush filing services may be available for an additional fee. Last-minute filings close to the due date may incur premium charges. We shall make reasonable efforts to meet the statutory due dates for tax filing, but we are not liable for delays caused by factors beyond our reasonable control, including but not limited to late submission of documents by the client, technical issues with the income tax portal, changes in law or procedure, or force majeure events.

  • Standard ITR filing: 10-20 days from receipt of complete documents
  • Complex returns (multiple income sources, capital gains): 15-30 days
  • Last-minute filings close to the due date may attract premium charges
  • Rush filing services available on request for an additional fee
  • Notice handling timelines depend on the type of notice and time available for response
  • Delays caused by incomplete or late submission of documents by the client are not counted toward standard timelines
  • We are not liable for missed deadlines caused by income tax portal issues, legal changes, or force majeure
  • Clients are advised to initiate the filing process well before the statutory due date

Confidentiality

Bizeneed India Private Limited is committed to protecting the confidentiality and privacy of all personal, financial, and tax-related information shared by individual clients. We implement appropriate technical, administrative, and physical safeguards to protect your data from unauthorised access, alteration, disclosure, or destruction. We do not share, sell, rent, or disclose your personal information to third parties except as required for the provision of our services (such as to our tax professionals), as required by applicable law or legal process, or with your explicit consent. Our tax professionals and staff are bound by confidentiality obligations. You are also expected to maintain the confidentiality of any drafts, computations, or interim documents shared with you during the service engagement.

  • All personal, financial, and tax-related information shared by you is treated as strictly confidential
  • We implement appropriate technical and administrative safeguards to protect your data
  • Your information is not shared with third parties except as required for service delivery or by law
  • Our professionals and staff are bound by confidentiality obligations
  • Clients are expected to maintain confidentiality of drafts, computations, and interim documents
  • Data is retained only as long as necessary for service delivery and legal compliance
  • You may request deletion of your data after service completion, subject to legal retention requirements

Limitation of Liability

To the maximum extent permitted under applicable Indian law, including the Information Technology Act, 2000 and the Consumer Protection Act, 2019, Bizeneed India Private Limited's aggregate liability under any service engagement or claim arising from these Terms or the use of our services shall not exceed the service fees paid by you for the specific ITR filing service in the preceding 12 months. We shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of tax benefits, loss of refunds, penalties from tax authorities, loss of data, or any other financial loss arising from the use or inability to use our services. We are not liable for penalties, interest, or adverse outcomes arising from incorrect, incomplete, or misleading information provided by you. We are also not liable for delays, rejections, or adverse outcomes caused by the Income Tax Department, NSDL, UTIITSL, or any other government authority or third-party service provider.

  • Aggregate liability limited to fees paid for the specific ITR filing service in the preceding 12 months
  • No liability for indirect, incidental, special, consequential, or punitive damages of any kind
  • No liability for penalties, interest, or adverse outcomes from incorrect or incomplete information provided by you
  • Not liable for delays, rejections, or adverse outcomes caused by the Income Tax Department or third-party service providers
  • Not liable for loss of tax benefits, refunds, or deductions due to late filing, incorrect filings, or information errors
  • No liability for service interruptions due to income tax portal issues, government actions, or force majeure events
  • Nothing in these Terms excludes liability for fraud or fraudulent misrepresentation by Bizeneed

Termination

Either party may terminate the service engagement by providing not less than 15 days' prior written notice to the other party. Bizeneed may immediately suspend or terminate services without prior notice if you breach these Terms, fail to make payments when due, provide false, misleading, or inaccurate information, or engage in any fraudulent activities. Upon termination, all outstanding fees and charges for services already rendered become immediately due and payable. We will make reasonable efforts to return all documents provided by you and provide a summary of work done. Access to our platform and related services will be suspended upon termination. Provisions of these Terms that by their nature should survive termination, including confidentiality, limitation of liability, and dispute resolution, shall remain in full force and effect.

  • Either party may terminate with not less than 15 days' prior written notice
  • We may immediately suspend or terminate for breach of Terms, non-payment beyond 15 days, or fraudulent activity
  • All outstanding fees for services already rendered become immediately due and payable upon termination
  • Documents provided by you will be returned upon request after termination
  • Access to the Platform and all associated services will be suspended upon termination
  • Provisions relating to confidentiality, liability, and dispute resolution survive termination

Dispute Resolution

Any dispute arising from or in connection with these Terms and Conditions, or the individual ITR filing services provided by Bizeneed, shall first be attempted to be resolved through good-faith negotiations for a period of 30 days from the date of written communication of the dispute by either party. If the dispute cannot be resolved through negotiation, it shall be referred to arbitration under the Arbitration and Conciliation Act, 1996 before a sole arbitrator appointed by mutual consent of both parties. The seat of arbitration shall be New Delhi, Delhi, India, and the language of arbitration shall be English. The arbitration award shall be final and binding on both parties. These Terms shall be governed by and construed in accordance with the laws of India, without regard to its conflict of law provisions. The courts in New Delhi, Delhi, India shall have exclusive jurisdiction over any disputes not resolved through arbitration.

  • Disputes shall first be attempted to be resolved through good-faith negotiations for 30 days
  • Unresolved disputes are referred to arbitration under the Arbitration and Conciliation Act, 1996
  • Sole arbitrator to be appointed by mutual consent of both parties
  • Seat of arbitration: New Delhi, Delhi, India
  • Language of arbitration: English
  • The arbitration award shall be final and binding on both parties
  • These Terms are governed by the laws of India without regard to conflict of law provisions
  • Courts in New Delhi, Delhi, India have exclusive jurisdiction over disputes not resolved through arbitration
